2. PRODUCTS & PRICING

All products sold on fajena.com are Colombian shapewear garments. Prices are displayed in USD and are final at the time of purchase. Fajena reserves the right to modify prices at any time without prior notice. The price charged is the one displayed at the time the order is placed.
No VAT is charged — Fajena operates under the French micro-enterprise VAT exemption (art. 293 B French Tax Code).

3. PURCHASE PROCESS

By completing a purchase on fajena.com, the Customer confirms that:
- They are at least 18 years old or have parental consent
- The information provided (name, address, payment details) is accurate and complete
- They have read and accepted these Terms of Sale in full
- They understand that the sale is final once the order confirmation email is received

4. PAYMENT
─────────────────────────────
Fajena accepts the following payment methods: credit card (Visa, Mastercard, American Express), and any other method displayed at checkout.
All transactions are secured via SSL/TLS encryption and processed by PCI-DSS Level 1 certified providers. Fajena does not store full payment card details.
Payment is collected immediately upon order placement. In the event of a payment failure, the order will not be processed.

5. ORDER CONFIRMATION

An order confirmation email is sent automatically after successful payment. This email constitutes proof of purchase and includes your order number, product details, and shipping address.
Please retain this email — it is required for any return, refund, or support request.

6. TITLE & RISK TRANSFER
─────────────────────────────
Title to the products passes to the Customer upon full payment. Risk of loss or damage transfers to the Customer upon handover to the carrier.

7. CANCELLATIONS
─────────────────────────────
Orders may be cancelled within 24 hours of placement by emailing fajena@proton.me with your order number. After 24 hours, the order may already be in preparation or shipped and cannot be cancelled. In that case, the Customer may exercise their right of withdrawal upon receipt (see Return & Refund Policy).

8. CHARGEBACKS & DISPUTES
─────────────────────────────
Before filing any chargeback or payment dispute with your bank or card issuer, the Customer must contact Fajena at fajena@proton.me and allow 5 business days for resolution.
Fajena maintains full records of all transactions including order confirmations, shipping proofs, IP addresses, and Terms acceptance timestamps. This evidence will be submitted to dispute any chargeback filed without prior contact.
Chargebacks filed in bad faith or without following the required contact procedure may result in the Customer being permanently banned from fajena.com and may be subject to legal action.

9. RETURNS & REFUNDS

Summary:
- 14-day right of withdrawal for EU/UK customers
- 30-day return window for defective items
- Refunds processed within 14 days of return receipt
- Items must be unworn, unwashed, with tags attached

10. WARRANTIES

All products sold by Fajena are covered by:
- Legal warranty of conformity: 2 years from delivery
- Warranty against hidden defects: 2 years from discovery
These legal warranties cannot be excluded or limited and apply regardless of any commercial guarantee offered.

11. LIMITATION OF LIABILITY
─────────────────────────────
Fajena's total liability for any claim arising from a purchase shall not exceed the amount paid for the order in question. Fajena is not liable for indirect, incidental, or consequential damages including loss of profits, data, or business opportunities.
Fajena products are cosmetic shapewear garments and are not intended to diagnose, treat, cure, or prevent any medical condition.

12. INTELLECTUAL PROPERTY

The purchase of a Fajena product does not transfer any intellectual property rights to the Customer. All trademarks, logos, product names, and site content remain the exclusive property of Martin Clauser.

13. PRIVACY

Personal data collected during the purchase process is handled in accordance with our Privacy Policy and GDPR (EU) 2016/679. For any data-related request: fajena@proton.me

14. GOVERNING LAW & DISPUTES
─────────────────────────────
These Terms of Sale are governed by French law. In the event of a dispute, the parties shall first attempt amicable resolution. If unsuccessful, the Customer may refer to our designated mediator free of charge:

If mediation fails, French courts shall have exclusive jurisdiction.

15. CHANGES TO THESE TERMS

Fajena reserves the right to update these Terms of Sale at any time. The version in effect at the time of purchase applies to that transaction. Continued use of fajena.com after any update constitutes acceptance of the revised Terms.
